Bluetwo IT Solutions (Pty) Ltd. (Bluetwo) provides to businesses and consumer users a variety of information technology-related products and services, including internet access, web hosting, telecommunications and connectivity services (each a Service and collectively the Services).
This document defines the circumstances and the terms and conditions upon which the Services may be used (Acceptable Use), with a view to ensuring the integrity, security, reliability and privacy of the Bluetwo network, systems, products and services (Bluetwo Network).
For the purposes of this document, a Customer is any person or entity that purchases, uses or receives a Service from Bluetwo. Every Customer must comply with this policy.
The following activities constitute violations of this policy, an abuse of the Bluetwo Network and are practices that are prohibited (Prohibited Activity):
Illegal Use. Using the Services to transmit any material (by email, uploading, posting or otherwise) that, intentionally or unintentionally, violates any applicable local, state, national or international law, or any applicable rules or regulations.
Threats . Using the Services to transmit any material (by email, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property.
Harassment. Using the Service to transmit any material (by email, uploading, posting or otherwise) that harasses another.
Fraudulent Activity. Using the Services to make fraudulent offers to sell or buy products, items or services or to advise any type of financial scam such as a "pyramid scheme", and chain letters.
Spam. Sending unsolicited commercials, messages or communications or unsolicited bulk email in any form or any activities that have the effect of facilitating unsolicited commercial email or unsolicited bulk email whether or not that email is commercial in nature.
Forgery or Impersonation . Adding, removing or modifying any identifying information (including any network header information in an effort to deceive or mislead or attempting to impersonate any person by using forged headers or other identifying information.
Unfair Use of resources: Bluetwo Internet Solutions requires you to act responsibly in your use of resources on the Bluetwo's Network and systems. If you use unreasonably excessive resources on Bluetwo's Network and systems, your access may be suspended or terminated at any time, without notice.
General . Engaging in any activity that constitutes any of the following:
(a) Violates the law or regulation (including but not limited to defamation, invasion of privacy, harassment, child pornography, export laws and regulations, infringement or misappropriation of intellectual property rights).
(b) Is offensive, indecent, or harmful to minors.
(c) Threatens the integrity and/or security of any network or computer system (including but not limited to transmission of worms, viruses and other malicious codes and accessing any device or data without proper authorization).
(d) Attempts to use the Service in a manner so as to avoid incurring charges for or otherwise being required to pay for usage.
(e) Otherwise degrades or interferes with any other Customer's use of a Service or that adversely affects the integrity, security or service levels of the Bluetwo Network.
(f) Breaches of third party non disclosure agreement or obligation.
(g) Violates generally accepted standards of Internet or other network conduct and usage, including, but not limited to, denial of service attacks, web page defacement, port and network scanning and unauthorized system penetrations.
Bluetwo does not monitor or judge the content of information transmitted using any Services, but will investigate complaints of possible inappropriate use. In the course of any investigation Bluetwo will use its reasonable endeavours to safeguard the privacy of all parties and will follow the guidelines given in this policy and in Bluetwo's privacy policy. However, where required to do so, Bluetwo may disclose a Customer's account details or activity logs or other information relevant to the Customer's Services.
If Bluetwo becomes aware of any Prohibited Activity, or it suspects any Prohibited Activity, Bluetwo may do any of the following:
Suspend or terminate a Customer's Service at any time for any material failure of a Customer, its representatives or its users to comply with this policy or for engaging (or permitting others to engage) in a Prohibited Activity (as determined by Bluetwo in its absolute discretion).
Deny traffic for the purpose of preserving Customer's system and network resources.
Where feasible, implement technical mechanisms to prevent a Prohibited Activity.
Charge the Customer to recover administrative costs associated with the Prohibited Activities of the Customer including but not limited to recovery of the costs of identifying offenders and removing them from or discontinuing providing them Service, in an amount equal to Bluetwo's actual expenses incurred in preventing or responding to the Prohibited Activity.
Remove any materials that, in Bluetwo's sole discretion may be illegal, may subject Bluetwo to liability or that may violate this policy.
Co-operate with legal authorities and/or third parties in the investigation of any suspected or alleged crime, civil wrong or Prohibited Activity.
Customers are responsible for protecting any access codes or other security measures for use of or access to a Service from any authorized or unauthorized use. Customers must not use or permit anyone to use the Bluetwo Network or Services to guess passwords or access other systems or networks without written authorization Customers must comply with any security requirements that Bluetwo may notify from time to time.
Bluetwo reserves the right to change this policy from time to time. Any changes to this policy will be posted on the Bluetwo website at (http://www.bluetwo.co.za/terms.asp).
